Absolute@work and Absolute@construct (together: "Absolute Jobs", "we", "us" or "our company") are separate and independent legal entities. Depending on the processing activity within which your personal data are processed, they may be considered as separate controllers or joint controllers for the personal data processed within the scope of our company's activities. 

1.2 We make every effort to protect and process personal data entrusted to us in a proper and transparent manner, in particular in accordance with applicable law and, in particular, the General Data Protection Regulation 2016/679 of 27 April 2016 ("AVG" or "GDPR").

3. For what purposes do we process personal data?  

3.1 I am a website visitor.

We process your personal data only for legitimate business purposes. These purposes include, but are not limited to:

3.3 I am a job applicant.

3.3.1 The purpose for which your personal data are processed is to register your application for a temporary worker vacancy published on our website (via the contact form, via the application form or via the "spontaneous application" form). If your application leads to the start of a selection procedure, we will process your personal data for the creation and/or fine-tuning of your profile, which means that we will process all necessary data required to assess your application with a view to possible recruitment and employment as a temporary worker. This assessment may also include an assessment by an external party ("assessment"). 

3.3.2 Our website also allows you to create an account so that your personal data is automatically filled in each time you are logged in and apply for vacancies on our website. In this way, we try to facilitate your application, and you avoid having to enter your personal information every time.

3.3.4 In case of a positive assessment and decision to hire you, we will also use your personal data to prepare the employment contract. 

4. The legal grounds for processing personal data

4.1.1 When you contact us via the online contact form, your personal data will in principle be processed for the protection of our legitimate interests (i.e. the interest to handle your questions, requests and complaints in the best possible way).

4.1.2 For sending our newsletters, we will always ask for your explicit consent. 

4.2 I am a contact (contacts of) a supplier, a customer, a potential customer or any other person whose personal data is processed in the course of business activities.

4.2.1 We process your personal data for the purposes set out above:

for the purpose of concluding and performing agreements concluded with you;
in order to comply with our legal obligations;
in the context of the legitimate interests of our company and/or a third party, such as (but not limited to) the proper conduct of our business activities, customer and supplier management, etc. In this regard, we will always determine on a case-by-case basis whether our interests outweigh your interests, fundamental rights and freedoms.
4.2.2 If we are required by law to obtain your free, informed, specific and unambiguous consent to process your personal data for certain purposes (e.g. specific direct marketing or market research activities), we will only process your data for these purposes when we have received such consent from you.

4.3 I am a job applicant

4.3.1 The processing of your personal data is necessary to take measures prior to the conclusion of an employment contract and it is in our legitimate interest, i.e. the interest to assess you before making you an offer of employment, which also seems to us to be in your interest (or at least outweighs our interest). Keeping your data for a well-defined period in order to contact you in case of future opportunities also falls within our legitimate interest. 

5. What rights do you have? 

5.1 You have several rights in relation to the personal data we process about you. In particular, you have the right to:

access and request a copy of your personal data insofar as this does not infringe the rights and freedoms of others;
ask to update or correct your personal data if you believe it to be inaccurate or incomplete;
ask for your personal data to be deleted, or to restrict the way in which we use it, if you believe that we do not or no longer have a lawful processing ground;
withdraw your consent in relation to the processing of your personal data(to the extent that the processing is based on your consent);
receive your personal data in a structured, common and machine-readable form and transfer it to another party (insofar as the processing is based on consent or the performance of a contract), and insofar as this does not infringe the rights and freedoms of others

Application form
Via the website, you can apply for specific vacancies via the application form. We process the following data in this context: first name, surname, gender, address, country, e-mail address, telephone number and your CV. 

Registration as an applicant
Through our website, you can create an account as an applicant. In this context, we process your login data (e-mail address and password), and the following personal information: first name, surname, gender, address, country, telephone number and your CV.  

Spontaneous application
You can apply spontaneously via our website. We process the following data in this context: first name, surname, gender, address, e-mail address, telephone number, CV, country and your description of your ideal job.

11.2.3 E-mail traffic is in principle kept for 1 year on our server and for 1 year in backup.  

11.2.4 However, depending on the specific situation and applicable national legislation, we may keep your personal data for longer periods. In particular, this will be the case if one of the following periods is longer: (i) as long as necessary for the activity or service concerned; (ii) the legally required retention period; or (iii) the limitation period within which legal proceedings can be initiated.

11.3 I am a job applicant.

11.3.1 We will retain your personal data for the period necessary in light of the purposes set out above. If the application does not result in an employment relationship, your personal data will be retained for one year after the end of the recruitment process for the purposes discussed above.

12. Will your personal data be used for automated decision-making?

12.1 Automated decisions are decisions about individuals based solely on the automated processing of personal data and which produce legal effects that significantly affect the individuals concerned.

12.2 As a rule, we do not use personal data for automated decision-making. We thus do not make decisions about you based solely on the automated processing of your personal data.
